The results

Texas personal injury settlement amounts we have recovered

Every figure below is a real recovery for a real client, in Travis, Williamson, or Bexar County. Beside each number is the decision that produced it: the cap we broke, the evidence we found, or the dispute we took apart.

Six recoveries, largest first. Each one lists the attorney, the county, and the stage at which it resolved. Settlement amounts in Texas personal injury cases turn on facts like these, not on formulas, which is why no two cases are worth the same.

The attorneys who handled them try cases rather than simply file them, and that is what moves an insurer off its opening offer.

12× the insurer’s only offer

Commercial vehicle crash: they capped it at $500,000. We proved them wrong.

A distracted driver ran a red light and hit our client head-on, fracturing their back and both ankles. The injuries required surgeries and eight months of recovery. For five of those months our client could not walk, and could not care for their disabled child.

The human cost was enormous. The legal problem was that the driver was working for a non-profit. Under the Texas Charitable Immunity and Liability Act, when a charitable organization causes an injury through ordinary negligence, recovery may be limited to $500,000 per person, no matter how devastating the harm. The insurance company knew that rule cold. Their position was simple: this accident falls under the statute, so your case is worth half a million dollars. Their first and only offer was the statutory limit, take it or leave it.

How we broke the cap

That limit generally applies only to ordinary negligence. Establish conduct beyond it and the protection falls away. So we dug into what the driver was actually doing in the seconds before impact, and we proved they were on a cell phone and smoking at the wheel when they ran the light, the kind of proof that decides distracted driving cases. That is not a momentary lapse. That is a choice.

When the defense moved for summary judgment to lock the case inside the $500,000 limit, we defeated the motion. Once the court let the gross-negligence question go forward, the entire risk calculation changed for the other side.

The case settled after suit, at mediation, three and a half years after we started, for $6,000,000 — twelve times the number the insurer first insisted was the ceiling.

18-wheeler settlement without a lawsuit: a seven-figure recovery.

An 18-wheeler rear-ended our client on the highway. The force of the collision caused a lumbar fracture that required surgery. For eight months our client could not work, and for the first four months needed hired care staff simply to get through the day.

This was not an inconvenience. It was a catastrophic disruption to a working person’s ability to earn a living, run a household, and take care of themselves and their family, all because a commercial truck could not stop in time.

Why this one never needed a lawsuit

Cases against trucking companies for this kind of money almost always take years and a filed lawsuit to resolve. Insurers know the courthouse is slow and expensive, and they use that against injured people.

This case did not follow that script. We built the liability and damages picture so thoroughly, and so early, that the trucking company’s insurer chose to settle pre-litigation rather than let us take it any further.

Our client received a life-changing recovery of $6,000,000 without the years of stress a filed trucking case usually demands.

Wrongful Death

A widow and three children

Wrongful death on IH-35: a video no one knew existed.

Our client’s husband was changing a tire on the shoulder of IH-35 when a commercial driver fell asleep at the wheel and struck him directly. He did not survive. He left behind a wife and three children.

The couple had met and fallen in love in Ethiopia, immigrated to America to find opportunity, and were raising three beautiful children together. No amount of money can ever replace a father. What a settlement can do is make sure his family is not left without both the man they loved and the financial support he provided.

What made the difference

Liability was never formally disputed in the end, but it was not simply handed to us either. We still had to establish exactly what happened on that shoulder, and how.

Through discovery we located a video, captured by another truck on the highway, that recorded the impact and the death that followed. That footage removed any room to argue about how this crash occurred or who was responsible for it.

We brought the wrongful death claim on behalf of the wife and all three surviving children and resolved it after filing suit for $3,950,000. The recovery gave a widow and three children the ability to continue the life their husband and father crossed the world to build for them.

4.75× the opening offer

18-wheeler collision: from a $600,000 offer to nearly three million.

Our client was T-boned by the defendant driver in an 18-wheeler collision. The impact required shoulder surgery and nine months of recovery, and it took our client two full years to return to the active lifestyle they had lived before the crash.

This was someone whose sense of themselves was tied to being able to move, work, and stay active, and the crash took that away for a long time. The defense fought on both fronts. They disputed liability, whose fault the wreck was, and they disputed damages, how much the injury had really cost our client’s life. Their opening offer was $600,000, a number built on the assumption that neither dispute would ever be resolved against them.

How we moved the number

We took apart the liability dispute first and proved the defendant driver caused the crash. Then we did the harder, more important work of showing what the injury truly took from our client: not just a surgery and a recovery timeline on paper, but a real, measurable, lasting decrease in their quality of life.

Once both pieces were firmly established, the leverage shifted.

The case settled after lawsuit for $2,850,000 — more than four and a half times the insurer’s first offer.

The business had to change how it operates

Trampoline park injury: a design defect that changed how a business operates.

Our client walked into a children’s trampoline park as an ordinary, healthy person and left with a catastrophic neck injury. The business had created an unsafe condition on its premises: an uncovered bar that was, in truth, a design defect.

The park did not have proper warning signs, and it did not have enough employees to supervise the area where people were being put at risk. A place built for families to have fun had a hazard designed into it that no customer could have seen coming.

How we built it

A premises case turns on the condition itself and on what the operator knew or should have known about it. We built the case around the unsafe condition and the operator’s failure to guard against it, rather than treating this as an ordinary fall.

The result went beyond compensation. As a direct result of this case, the trampoline park now stations designated security personnel at the entrance of the trampoline area and has added warning signage where there was none before. The next family that walks through those doors is safer because of what happened to our client.

The matter resolved after filing suit, at mediation, for $1,500,000 — and it changed how the business operates.

Taken through a filed lawsuit

18-wheeler litigation: trucking companies do not pay fair numbers politely.

An 18-wheeler crash in Travis County, taken all the way through a filed lawsuit and resolved for our client for $1,200,000.

Trucking cases are rarely simple. The companies behind these vehicles carry large insurance policies and hire lawyers whose job is to keep payouts small, which means an injured person almost never gets a fair number by asking politely. We filed suit, pursued the case through litigation, and did the work required to hold the trucking company accountable for the harm it caused, rather than accepting what the insurer was willing to offer on its own terms.

Common questions

What determines a settlement amount in Texas

What sets the ceiling on a claim?

Usually the available insurance coverage, not the severity of the injury. That is why claims against commercial defendants and trucking companies, who carry far larger policies, tend to resolve higher.

How does fault change the number?

Texas uses modified comparative fault under Chapter 33 of the Civil Practice & Remedies Code. Your recovery drops by your share of the blame, and under Section 33.001 you generally recover nothing if you are found more than 50 percent responsible.

Are there legal caps?

Generally no cap on compensatory damages in ordinary negligence, but exceptions matter. Chapter 84 may limit a charitable organization to $500,000 per person, the Texas Tort Claims Act caps claims against government, and Section 41.008 limits exemplary damages.

Is the figure what the client receives?

No. These are gross recoveries, and attorney fees, case expenses and medical liens come out of them. Under Chapter 55 of the Texas Property Code a hospital may assert a lien against an injury recovery.
